A BILL
TO AMEND ARTICLE 1, CHAPTER 25, TITLE 57, CODE OF
LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION
57-25-30 SO AS TO PROVIDE THAT BUS SHELTERS MAY BE
ERECTED AND MAINTAINED WITHIN THE
RIGHTS-OF-WAY OF PUBLIC ROADS UPON
AUTHORIZATION OF THE APPROPRIATE GOVERNMENTAL
AUTHORITY, AND TO PROVIDE FOR THE MANNER IN
WHICH ADVERTISING MAY BE PLACED IN THESE BUS
SHELTERS.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Article 1, Chapter 25, Title 57 of the 1976 Code
is amended by adding:
"Section 57-25-30. Bus shelters, including those on which
commercial advertisements are placed, may be erected and
maintained within the rights-of-way of public roads by
municipalities, counties, public transit systems, or any person
specifically authorized to do so by the State, county, municipality,
or other entity having jurisdiction over the rights-of-way. A bus
shelter to be located within the right-of-way of a state or federal aid
primary road shall comply with all applicable requirements of the
Department of Transportation, Title 23 of the United States Code,
and Title 23 of the Code of Federal Regulations. A bus shelter to
be located within the right-of-way of a road other than a state or
federal aid primary road shall comply with all applicable
requirements of the municipality or county within whose
jurisdiction it is to be located."
SECTION 2. This act takes effect upon approval by the
Governor.
