AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61-9-315 SO AS TO PROVIDE FOR A THREE-TIERED SYSTEM FOR MANUFACTURING, DISTRIBUTING AND SELLING BEER AND TO PROVIDE CERTAIN EXEMPTIONS THEREFROM; AND TO REPEAL SECTION 61-9-350 WHICH PERMITS A BEER WHOLESALER TO OBTAIN A RETAIL PERMIT TO SELL BEER AT HIS WHOLESALE LOCATION ONLY.

Be it enacted by the General Assembly of the State of South Carolina:

ReStrictions on wholesale permit

Section 1. The 1976 Code is amended by adding:

"Section 61-9-315. (a) The holder of a wholesale permit granted under Section 61-9-310, directly or indirectly, individually or as a member of a partnership or an association, as a member or stockholder of a corporation, or as a relative to any person by blood or marriage within the third degree, shall not have any interest whatsoever in any other business, store or establishment dealing in beer or wine at retail; provided, however, the limitation above stated shall not apply with respect to any interest held on July 1, 1980 by the holder of a wholesale permit in any business operated by the holder of a retail permit at premises other than the premises at which his wholesale business is operated.

(b) A manufacturer or brewer of beer, ale, porter or other malt beverages or any person who imports such products produced outside the United States shall not have any interest whatsoever in any beer business of a person holding a wholesale permit or holding a retail permit or in any partnership or corporation for the use and benefit of which such wholesale or retail permit is held.

(c) A manufacturer or brewer of beer, ale, porter or other malt beverages or any person who imports such products produced outside the United States shall not sell, barter, exchange, transfer or deliver for consumption any beer to any person not having a wholesale permit granted under Section 61-9-310, and a holder of a wholesale permit shall not sell, barter, exchange, transfer, or deliver for consumption any beer to any person not having a retail permit."

Repeal

Section 2. Section 61-9-350 Of the 1976 Code is repealed.

Time effective

Section 3. This act shall take effect upon approval by the Governor.
