AN ACT TO AMEND SECTION 40-43-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MEETINGS OF THE BOARD OF PHARMACEUTICAL EXAMINERS, SO AS TO CHANGE THE NAME TO "THE BOARD OF PHARMACY", CHANGE THE MEETING PLACE FROM THE CITY OF CHARLESTON TO COLUMBIA, REQUIRE MEETINGS AT LEAST THREE TIMES A YEAR INSTEAD OF EVERY FOUR MONTHS AND TO CHANGE THE NUMBER NECESSARY FOR A QUORUM AND TO AMEND SECTION 40-43 60, RELATING TO PHARMACISTS, SO AS TO PROVIDE FOR THE ESTABLISHMENT OF PRACTICAL EXPERIENCE REQUIREMENTS AND CERTAIN STANDARDS FOR PHARMACY INTERNS BY REGULATIONS OF THE BOARD OF PHARMACY.

Be it enacted by the General Assembly of the State of South Carolina:

Application for examination as registered pharmacist

Section 1. Section 40-43-50 of the 1976 Code is amended to read:

"Section 40-43-50. An applicant for examination as a registered pharmacist must be twenty-one years of age, of good moral character and temperate habits, a graduate from a school, college or department of pharmacy of a university which is recognized by the board, such recognition to be established by the board on the basis of uniform and reasonable standards of educational requirements to be observed by schools, colleges or departments of pharmacy of universities.

Applicants shall furnish proof of attendance at the school, college or department of pharmacy from which the applicant is a graduate. All applicants for licensure by examination shall also obtain practical experience in the practice of pharmacy under such terms and conditions as the board shall determine. The board shall establish standards for internship or any other program necessary to qualify an applicant for the licensure examination and shall also determine the necessary qualifications of any preceptor used in any internship or other program. Such standards and qualifications shall be established by regulations promulgated pursuant to Act 176 of 1977. The board, prior to promulgation of such regulations, may in its discretion accept credit for any internship completed prior to April 1, 1980, in a program not previously recognized by the board.

Any physician, licensed to practice medicine in this State, shall also be allowed to take the examination for the practice of pharmacy, as provided herein."

SECTION 2. Section 40-43-20 of the 1976 Code is amended to read:

"Section 40-43-20. The board shall be styled 'The Board of Pharmacy' and shall meet in the City of Columbia or any other place in the State which may be designated by the board at least three times a year and keep in session until applicants who have previously made timely and appropriate application to the Executive Secretary of the board shall have been examined. A simple majority of the members of the board shall constitute a quorum for the transaction of business and granting licenses. The board may elect a chairman and a secretary and may also adopt any regulations for the conduct of its business and needful for the proper discharge of the business of the board; provided, such regulations shall not conflict with any of the provisions of this chapter."

Section 3. This act shall take effect upon approval by the Governor.
