AN ACT TO AMEND SECTION 7-7-80, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO VOTING PRECINCTS IN ANDERSON COUNTY, SO AS TO REDEFINE PRECINCT LINES WITHIN THE CITY OF ANDERSON.

Be it enacted by the General Assembly of the State of South Carolina:

Voting precincts in Anderson County

SECTION 1. Section 7-7-80 of the 1976 Code, as last amended by Act 296 of 1984, is further amended to read:

"Section 7-7-80. (a) All the precinct names, precinct lines, and polling places in Anderson County, except precincts within the municipal boundaries of the city of Anderson, are as shown on maps filed with the Clerk of Court of the county, the State Election Commission, and the Division of Research and Statistical Services of the State Budget and Control Board as of March 1, 1984. The written descriptions of the precinct names, lines, and polling places must be filed with the maps.

(b) The precincts and polling places within the municipal boundaries of the city of Anderson are as follows:

(1) The first precinct of Ward 1 consists of that area bounded on the north by the city limits; on the west by the city limits; on the south by Whitehall Road and Concord Road; and on the east by Concord Road and the city limits. The voting place for the first precinct of Ward 1 is Whitehall Elementary School.

(2) The second precinct of Ward 1 consists of that area bounded on the north by the city limits; on the west by Concord Road and North Main Street, on the south by Concord Avenue and Millgate Road; and on the east by Cox's Creek and the city limits. The voting place for the second precinct of Ward 1 is Concord Elementary School.

(3) The first precinct of Ward 2 consists of that area bounded on the north by Millgate Road and Concord Avenue; on the west by North Main Street; on the south by East Calhoun Street; on the east by North Fant, East Greenville Street, and Cox's Creek. The voting place for the first precinct of Ward 2 is the Anderson County Library.

(4) The second precinct of Ward 2 consists of that area bounded on the north by the city limits; on the west by North Fant Street, East Greenville Street, and Cox's Creek; on the south by East Calhoun Street, Wilson Street, Wildwood Drive, and Old Williamston Road; and on the east by the city limits. The voting place for the second precinct of Ward 2 is the Sheppard Community Center.

(5) The first precinct of Ward 3 consists of that area bounded on the north by East Calhoun Street, Wilson Street, Wildwood Drive, and Old Williamston Road; on the west by North Main Street; on the south by the Northwestern Railroad line track and the city limits; and on the east by Cox's Creek. The voting place for the first precinct of Ward 3 is Osborne Avenue Church of God.

(6) The second precinct of Ward 3 consists of that area bounded on the north by the city limits and Old Williamston Road; on the west by Cox's Creek; on the south by the city limits; and on the east by the city limits. The voting place for the second precinct of Ward 3 is the Nevitt Forest School.

(7) The first precinct of Ward 4 consists of that area bounded on the north by the Northwestern Railroad line track and the city limits; on the west by Main Street; on the south by East Franklin Street and East River Street; and on the east by the city limits. The voting place for the first precinct of Ward 4 is McCants School.

(8) The second precinct of Ward 4 consists of that area bounded on the north by East River Street and East Franklin Street; on the west by South Main Street; and on the south and east by the city limits. The voting place for the second precinct of Ward 4 is South McDuffie School.

(9) The first precinct of Ward 5 consists of that area bounded on the north by the northwestern Railroad line, Kelly Street, 'F' Street, and King Street; on the west by the city limits; on the south by West Market Street, the Seaboard Coastline Railroad line, and West Franklin Street; on the east by Main Street. The voting place for the second precinct of Ward 5 is the Anderson County Senior Citizens Center.

(10) The second precinct of Ward 5 shall consist of that area bounded on the north by West Franklin Street, the Seaboard Coastline Railroad line, and West Market Street; on the west by the city limits; on the south by the city limits; and on the east by South Main Street. The voting place for the second precinct of Ward 5 is the Hudgens Community Center.

(11) The first precinct of Ward 6 consists of that area bounded on the north by Whitehall Road; on the west by the city limits; on the south by West Mauldin Street; and on the east by North Main Street. The voting place for the first precinct of Ward 6 is North Anderson School.

(12) The second precinct of Ward 6 consists of that area bounded on the north by West Mauldin Street; on the west by the city limits; on the south by King Street, Kelly Street, 'F' Street, and the Northwestern Railroad line; and on the east by North Main Street. The voting place for the second precinct of Ward 6 is the Anderson Recreation Center.

Following the annexation to the city of Anderson of any area not including a voting place and before a polling place has been established, it is lawful for any qualified voter residing in the area at the time of the annexation to vote in any general, special, municipal, or primary election, if otherwise qualified, upon production of a registration certificate showing that he is duly registered in the precinct from which the annexed area was taken. Any voter participating in the election shall vote at the polling place in the municipality nearest his residence and must furnish the managers with evidence satisfactory to them of his residence within the annexed area. When any person has voted under the provisions of this section, one of the managers shall forthwith write across the back of his registration certificate the word 'voted' with the date on which the election is held and the initials of the managers."

Board to change voter registration

SECTION 2. The Anderson County Board of Voter Registration shall appropriately change voter registration to reflect the new precinct for any person where registration is transferred to another precinct by virtue of the provisions of this act as provided by Section 7-7-720 of the 1976 Code.

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
