AN ACT TO AMEND SECTION 8-17-330, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO STATE AGENCY EMPLOYEE GRIEVANCE PLANS AND PROCEDURES, SO AS TO CHANGE THE TIME FOR APPEALING TO THE STATE EMPLOYEE GRIEVANCE COMMITTEE.

Be it enacted by the General Assembly of the State of South Carolina:

Time of appeal

SECTION 1. The third paragraph of Section 8-17-330 of the 1976 Code is amended to read:

"A state employee who wishes to appeal the decision of the agency grievance procedure to the State Employee Grievance Committee shall file a request for such an appeal within ten calendar days of receipt of the decision from the agency head or within fifty-five calendar days after the employee files the grievance with the agency, whichever occurs later. The employee or his representative shall file the request in writing with the state personnel director. Failure to file an appeal with the state personnel director within ten calendar days of the agency's final decision or fifty-five calendar days from the initial appeal, whichever occurs later, constitutes a waiver of the right to appeal."

SECTION 2. This act takes effect upon approval by the Governor.
