AN ACT TO AMEND ARTICLE 1, CHAPTER 11 OF TITLE 8, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO STATE OFFICERS AND EMPLOYEES, BY ADDING SECTION 8-11-83 SO AS TO PROVIDE THAT THE COMPTROLLER GENERAL AND ALL OTHER STATE AGENCIES, UPON REQUEST OF EMPLOYEES OF THE STATE, SHALL MAKE DEDUCTIONS FROM THE COMPENSATION OF THE EMPLOYEES FOR THE PAYMENT OF MEMBERSHIP DUES FOR THE SOUTH CAROLINA STATE EMPLOYEE'S ASSOCIATION, TO PROVIDE THAT RETIREES FROM A STATE AGENCY ALSO MAY HAVE WITHHELD FROM THEIR STATE RETIREMENT BENEFITS THEIR MEMBERSHIP DUES FOR THE ASSOCIATION, AND TO PROVIDE THAT NO DEDUCTION IS PERMITTED IF THE ASSOCIATION AT ANY TIME ENGAGES IN COLLECTIVE BARGAINING OR ENCOURAGES ITS MEMBERS TO STRIKE.

Be it enacted by the General Assembly of the State of South Carolina:

Payroll deduction for dues of State Employees' Association

SECTION 1. Article 1, Chapter 11 of Title 8 of the 1976 Code is amended by adding:

"Section 8-11-83. The Comptroller General and all other state agencies, upon request of employees of the State, shall make deductions from the compensation of the employees for the payment of membership dues for the South Carolina State Employees' Association. The Comptroller General and state agencies shall pay over to the association all amounts so collected or withheld. Retirees from a state agency also may have withheld from their state retirement benefits their membership dues for the South Carolina State Employees' Association. No deduction is permitted if the association at any time engages in collective bargaining or encourages its members to strike."

SECTION 2. This act takes effect upon approval by the Governor.
