AN ACT TO AMEND SECTION 16-23-440, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DISCHARGING FIREARMS AT OR INTO DWELLINGS, SO AS TO PROVIDE IT IS UNLAWFUL ALSO TO DISCHARGE FIREARMS AT OR INTO ANY BUILDING OR STRUCTURE REGULARLY OCCUPIED BY PERSONS AND TO ESTABLISH PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

Firing firearms at dwellings or occupied structures -- penalties

SECTION 1. Section 16-23-440 of the 1976 Code is amended to read:

"Section 16-23-440. Any person who unlawfully discharges or causes to be discharged firearms at or into a dwelling house or other building or structure regularly occupied by persons is guilty of a misdemeanor and, upon conviction, must be fined not more than one thousand dollars or imprisoned for not more than ten years, or both."

SECTION 2. This act takes effect upon approval by the Governor.
