AN ACT TO AMEND SECTION 17-4-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CREATION OF THE COMMISSION ON APPELLATE DEFENSE AND ITS MEMBERS, SO AS TO CHANGE THE PERSON TO SERVE FROM THE SOUTH CAROLINA BAR ASSOCIATION AND THE SOUTH CAROLINA TRIAL LAWYERS ASSOCIATION AND TO SET THE TERMS FOR THE MEMBERS.

Be it enacted by the General Assembly of the State of South Carolina:

New members and terms

SECTION 1. Section 17-4-20 of the 1976 Code is amended to read:

"Section 17-4-20. The Commission on Appellate Defense is created which consists of the following members:

(1) the Dean of the University of South Carolina Law School;

(2) the President of the South Carolina Public Defender's Association;

(3) a member of the South Carolina Bar Association appointed by the president of the association;

(4) a member of the South Carolina Trial Lawyers Association appointed by the president of the association;

(5) the Chairman of the South Carolina Judicial Council;

(6) the Chairman of the Senate Judiciary Committee or his designee;

(7) the Chairman of the Judiciary Committee of the House of Representatives or his designee.

The appointed members of the commission shall serve for a term of three years. The terms for appointments must be staggered.

The commission shall elect a chairman from among its membership to serve a one-year term. The court administrator is executive secretary for the commission.

The commission may adopt an appropriate seal and promulgate regulations consistent with the provisions of this chapter to govern its operations and procedures."

Terms of appointed members

SECTION 2. The initial term of the person appointed by the president of the South Carolina Bar Association is two years. The initial term of the person appointed by the president of the South Carolina Trial Lawyers Association is three years. The terms for each person appointed after the initial term is three years.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
