A BILL

TO AMEND SECTION 40-60-40 AND 40-60-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM THE LICENSING AND CERTIFICATION REQUIREMENTS OF THE SOUTH CAROLINA REAL ESTATE APPRAISER REGISTRATION, LICENSE, AND CERTIFICATION ACT AND THE CREATION OF THE SOUTH CAROLINA REAL ESTATE APPRAISER BOARD, SO AS TO EXEMPT SALARIED FEDERAL, STATE, AND LOCAL GOVERNMENT EMPLOYEES WHO APPRAISE REAL PROPERTY AS PART OF THEIR OFFICIAL DUTIES AND TO SPECIFY WHEN SUCH EMPLOYEES MUST BE LICENSED OR CERTIFIED; TO PROVIDE THAT STATE OR LOCAL GOVERNMENT EMPLOYEES WHO APPRAISE PROPERTY FOR PURPOSES OF AD VALOREM TAXES MUST BE LICENSED AS CERTIFIED BY THE LATER OF TWENTY-FOUR MONTHS AFTER THEIR EMPLOYMENT OR JULY 1, 1993, AND TO REQUIRE THAT ONE OF THE FOUR REAL ESTATE APPRAISER MEMBERS OF THE SOUTH CAROLINA REAL ESTATE APPRAISER BOARD MUST BE AN EMPLOYEE OF A STATE AGENCY EMPLOYING PERSONS REQUIRED TO BE LICENSED OR CERTIFIED AS AN APPRAISER AND THAT FOR THIS MEMBER PARTICIPATION IN BOARD ACTIVITIES IS CONSIDERED TO BE INCLUDED IN HIS OFFICIAL DUTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-60-40 of the 1976 Code, as added by Act 12 of 1991, is amended by adding:

"(3) a real estate appraiser who is a salaried employee of the federal government or an agency of the state government or a political subdivision who in the performance of his employment duties appraises or evaluates real estate or real property. However, when the appraisal or evaluation is to be used in a federally-related transaction, the employee must be licensed or certified under the provisions of this chapter if required by federal law or the guidelines established by the appraisal subcommittee. An employee of the federal government or an agency of the state government or political subdivision who also acts as an independent real estate appraiser is subject to the provisions of this chapter and must be registered, licensed, or certified before engaging in independent appraisal activity. Notwithstanding the provisions of this item, a person employed by the state government or political subdivisions as a salaried employee to perform appraisals for ad valorem tax purposes must become a state licensed or state certified appraiser within twenty-four months from the date of employment in that capacity or July 1, 1993, whichever is later."

SECTION 2. Section 40-60-50(A) of the 1976 Code, as added by Act 12 of 1991, is amended to read:

"(A) There is created the South Carolina Real Estate Appraisers Board which consists of seven members. All members must be residents of this State. One member must be a public member who may not be connected in any way with the practice of real estate appraisal, real estate brokerage, or mortgage lending. One member must be a licensed real estate broker who is not a real estate appraiser. One member must be actively engaged in mortgage lending, representing supervised financial institutions, who is not a real estate licensee or a real estate appraiser, and who also must not be connected in any way with the brokerage of real estate, the appraisal of real estate, or the review of real estate appraisals. Four members must be real estate appraisers who have been actively engaged in real estate appraisal for at least three years of which one member must be an employee of a state agency employing persons required to be licensed or certified pursuant to this chapter: For this state agency member, participation in board activities is considered to be included in the employee's normally assigned official duties to his employing agency. In appointing real estate appraisers to the board, while not automatically excluding other appraisers, the Governor shall give preference to real estate appraisers whose primary source of income is derived from appraising real estate and not real estate brokerage."

SECTION 3. This act takes effect upon approval by the Governor.
