A JOINT RESOLUTION TO AUTHORIZE THE SOUTH CAROLINA DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO INCREASE THE FISCAL YEAR 1992 NURSING HOME MEDICAID PERMITS OF CERTAIN NURSING HOMES; TO PROVIDE ALTERNATE METHODS FOR CALCULATING THE INCREASE; AND TO PROHIBIT ASSESSING A PENALTY THAT MAY OTHERWISE RESULT FROM THE CHANGE IN MEDICAID PATIENT DAYS PROVIDED BY A NURSING HOME.

Whereas, many nursing homes have been unable to increase the number of Medicaid days of care they are authorized to provide while changes in federal law have increased demand for Medicaid nursing home care. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Medicaid nursing home patient days increased

SECTION 1. (A) Notwithstanding Paragraph 39.28, Section 39, Part I of Act 171 of 1991, the General Appropriations Act for 1991-92, the South Carolina Department of Health and Environmental Control is authorized to increase the number of Medicaid patient days stated in permits issued pursuant to Article 2, Chapter 7, Title 44 of the 1976 Code.

(B) If requested by a nursing home within thirty days after the effective date of this joint resolution, the department is authorized to increase the number of Medicaid patient days stated in that facility's permit up to either:

(1) the total of the facility's fiscal year 1991 permit amount plus ninety-one percent of the additional Medicaid patient days the facility requested for fiscal year 1992; or

(2) ninety-one percent of fiscal year 1992 utilization as projected based on the first four months of the fiscal year.

(C) This joint resolution does not apply to additional Medicaid patient days requested in connection with a Certificate of Need which has been revoked by the department.

(D) A facility must not be assessed a penalty under Section 44-7-90(2) of the 1976 Code if the violation is a result of additional Medicaid days allocated pursuant to this joint resolution.

Time effective

SECTION 2. This joint resolution takes effect upon approval by the Governor.
