TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 42-5-205 SO AS TO REQUIRE EVERY INSURANCE CARRIER INSURING EMPLOYERS AGAINST LIABILITY FOR PERSONAL INJURIES TO THEIR EMPLOYEES OR DEATH CAUSED BY PERSONAL INJURIES, UNDER THE STATE WORKERS' COMPENSATION LAW, TO MAINTAIN AT ALL TIMES IN THIS STATE AT LEAST ONE RESIDENT ADJUSTER, TO REQUIRE THE CARRIER TO MAINTAIN ON FILE WITH THE CHIEF INSURANCE COMMISSIONER THE NAME, CURRENT ADDRESS, AND CURRENT TELEPHONE NUMBER OF THE ADJUSTER, AND TO PROVIDE THAT THE FAILURE TO MAINTAIN ON FILE THE REQUIRED INFORMATION CONSTITUTES GROUNDS FOR REVOKING THE CARRIER'S AUTHORIZATION TO DO BUSINESS IN THIS STATE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 5, Title 42 of the 1976 Code is amended by adding:
"Section 42-5-205. Every insurance carrier insuring employers in this State against liability for personal injuries to their employees or death caused by personal injuries, under the provisions of this title, shall at all times maintain in this State at least one resident adjuster for the purpose of investigation and settlement of claims. The name, current address, and current telephone number of the adjuster must be maintained on file with the Chief Insurance Commissioner by the carrier, and the information must be available to the public. A change in the name, address, or telephone number of the adjuster must be reported to the Chief Insurance Commissioner by the carrier within thirty days of the change.
Failure to maintain the name, current address, and current telephone number of the adjuster on file as required in this section is grounds for revocation by the Chief Insurance Commissioner of the carrier's authorization to do business in this State."
SECTION 2. This act takes effect upon approval by the Governor.
