TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-1-90 SO AS TO PROHIBIT A GOVERNMENTAL ENTITY FROM SELLING AN AGRICULTURAL OR HORTICULTURAL PRODUCT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 6-1-90. (A) For purposes of this section:
(1) `Governmental entity' is as defined in Section 6-15-10(3).
(2) `Agricultural or horticultural product' includes, but is not limited to, vegetables, fruits, flowers, sod, turf, and ornamental plants.
(B) After January 1, 1993, no governmental entity may sell an agricultural or horticultural product."
SECTION 2. This act takes effect upon approval by the Governor.
