That they have duly and carefully considered the same, and recommend that the same do pass:

A BILL

TO AMEND SECTION 16-11-700, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFENSE OF LITTERING, SO AS TO PROVIDE THAT LITTER INCLUDES CIGARETTES AND CIGARETTE BUTTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-11-700 of the 1976 Code, as last amended by Act 63 of 1991, is further amended by adding an appropriately lettered subsection to read:

"( ) For purposes of the offenses established by this section, litter includes cigarettes and cigarette butts."

SECTION 2. This act takes effect upon approval by the Governor.
