AN ACT TO AMEND SECTIONS 38-77-1120, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS UNDER THE "MOTOR VEHICLE THEFT AND MOTOR VEHICLE INSURANCE FRAUD REPORTING-IMMUNITY ACT", AND 23-41-20, RELATING TO DEFINITIONS UNDER THE SOUTH CAROLINA ARSON REPORTING-IMMUNITY ACT, SO AS TO PROVIDE THAT "AUTHORIZED AGENCY" OR "AUTHORIZED AGENCIES" INCLUDES THE UNITED STATES DEPARTMENT OF JUSTICE AND ITS FEDERAL BUREAU OF INVESTIGATION.

Be it enacted by the General Assembly of the State of South Carolina:

Definition of "authorized agency" expanded

SECTION 1. Section 38-77-1120(a) of the 1976 Code is amended to read:

"(a) `Authorized agency' means:

(1) the South Carolina State Law Enforcement Division, the State Highway Patrol, the sheriff's department of any county of this State, and any duly constituted criminal investigative department or agency of another state of the United States;

(2) the Attorney General of this State, any circuit solicitor of this State, any prosecuting attorney for a county, circuit, or district of another state or of the United States;

(3) the South Carolina Department of Insurance, the South Carolina Department of Highways and Public Transportation, and the South Carolina Department of Consumer Affairs; and

(4) the United States Department of Justice and its Federal Bureau of Investigation."

Definition of "authorized agencies" expanded

SECTION 2. Section 23-41-20(a) of the 1976 Code is amended to read:

"(a) `Authorized agencies' means:

(1) the State Fire Marshal when authorized or charged with the investigation of fires at the place where the fire actually took place;

(2) the Chief of the State Law Enforcement Division;

(3) the South Carolina Attorney General;

(4) the solicitor responsible for prosecution in the county where the fire occurred; and

(5) the United States Department of Justice and its Federal Bureau of Investigation."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
