TO REQUIRE INSURERS WHO OFFER OR PROVIDE HOMEOWNER'S INSURANCE TO OFFER, AS A PART OF THE CONTRACT OR POLICY OF HOMEOWNER'S INSURANCE, COVERAGE FOR AND PROTECTION AGAINST THE PERILS OF FLOOD, EARTHQUAKE, AND HAIL.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Every insurer licensed to transact business in this State who offers or provides homeowner's protection insurance shall offer to the insured or the prospective insured, as a part of the contract or policy of homeowner's insurance, coverage for and protection against the perils of flood, earthquake, and hail. Coverage for and protection against floods or flooding specifically includes damage caused by tidal surges resulting from hurricanes, other storms, or wind. The insured or the prospective insured shall indicate in writing whether he wants his contract or policy of homeowner's insurance to include coverage for and protection against the perils of flood, earthquake, and hail, or any of them, or none of them.
SECTION 2. This act applies to all existing contracts or policies of homeowner's insurance at the time they are renewed upon or after the effective date of this act, as well as to all new policies or contracts of homeowner's insurance issued or entered into upon or after the effective date of this act.
SECTION 3. This act takes effect upon approval by the Governor.
