TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11-9-140 SO AS TO REQUIRE THE STATE AUDITOR TO AUDIT THE USE OF STATE FUNDS TOTALING TWENTY THOUSAND DOLLARS OR MORE DIRECTLY APPROPRIATED FOR LOCAL CAPITAL IMPROVEMENT PROJECTS AND TO REQUIRE, IN ADDITION TO OTHER REMEDIES, FULL REIMBURSEMENT PLUS INTEREST TO THE STATE TREASURY IF THE AUDIT DETERMINES THAT FUNDS WERE NOT USED FOR THE PURPOSE FOR WHICH THEY WERE APPROPRIATED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 9, Title 11 of the 1976 Code is amended by adding:
"Section 11-9-140. The State Auditor shall conduct a complete audit of the use of state funds totaling twenty thousand dollars or more directly appropriated for local capital improvement projects. If the audit determines that the funds were not used for the purpose for which they were appropriated, the local authorities charged with implementing the project shall reimburse the State Treasury the full amount of the misapplied funds plus interest at the legal rate from the date the misapplied funds were made available. The provisions of this section are cumulative to other provisions of law relating to the use of state funds."
SECTION 2. This act takes effect July 1, 1991, and applies with respect to appropriations made after June 30, 1991.
