A BILL

TO AMEND SECTION 11-35-710, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS UNDER THE SOUTH CAROLINA CONSOLIDATED PROCUREMENT CODE, SO AS TO INCLUDE THE EXPENDITURE OF FUNDS BY STATE AGENCIES FOR SERVICES DESIGNED TO ADDRESS THE CRITICAL NEEDS OF PERSONS IN THE PERFORMANCE OF ACTIVITIES OF DAILY LIVING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 11-35-710 of the 1976 Code is amended by adding an appropriately lettered item to read:

"( ) expenditure of state and federal funds by state agencies for services designed to address the critical needs of persons in the performance of activities of daily living. Activities of daily living include, but are not limited to, bathing, dressing, eating, feeding, preparing food, toileting, assisting with bowel and bladder functions, housecleaning, transferring, and transporting. The agency shall determine if a service is designed to address critical needs. This determination is subject to review under the Administrative Procedures Act. The agency shall promulgate regulations setting forth criteria to determine the standards for selection of critical needs service providers. The criteria must be developed by the agency through recommendations submitted by agency advisory committees. The criteria must include, but is not limited to, quality of service, provider history, staff experience and qualifications, experience in the provision of the services to be offered, experience in providing services to the targeted population, and price. A policy manual containing the criteria and related agency requirements must be developed within the agency. The manual must be available to providers who wish to be considered for receipt of funds for critical needs services. The agency may renew a contract with an existing provider if it meets established criteria."

SECTION 2. This act takes effect upon approval by the Governor.
