A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-17-15 SO AS TO AUTHORIZE A SCHOOL DISTRICT TO CONTRACT WITH PRIVATE ENTITIES OR INDIVIDUALS FOR THE PURPOSE OF PROVIDING AUXILIARY SCHOOL SERVICES UNDER CERTAIN CONDITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 59-17-15. A school district of this State is authorized to contract with a private entity or individual for the purpose of having the private entity or individual, for an agreed upon consideration, provide auxiliary school services including food service, transportation, and required maintenance, landscaping, or janitorial services for the district or for any school in the district.

For liability and liability insurance purposes, the private entity or individual is not considered an agent or employee of the district but is considered an independent contractor."

SECTION 2. This act takes effect upon approval by the Governor.
