A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-73-736 SO AS TO PROVIDE FOR A REDUCTION IN RATES FOR AUTOMOBILE LIABILITY INSURANCE FOR A PERSON FIFTY-FIVE YEARS OF AGE OR OLDER WHO SUCCESSFULLY COMPLETES A MOTOR VEHICLE ACCIDENT PREVENTION COURSE APPROVED BY THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-73-736. A schedule of rates, rate classifications, or rating plans for motor vehicle liability insurance filed with the commissioner must provide for an appropriate reduction in premium charges for those insured persons who are fifty-five years of age or older and who qualify as provided in this section. Only those insured persons who successfully complete a motor vehicle accident prevention course approved by the Department of Highways and Public Transportation qualify for a three-year period after the completion of the course for the reduction in rates. No reduction in premiums is allowed for a self-instructed course or for a course that does not provide actual classroom instruction for a minimum number of hours as determined by the Department of Highways and Public Transportation.

The commissioner and the Department of Highways and Public Transportation may promulgate regulations to assist them in carrying out the provisions of this section.

All insurers writing motor vehicle liability insurance in this State shall allow an appropriate reduction in premium charges to all eligible persons subject to the provisions of this section. Upon successfully completing the approved course, the course's sponsor shall issue to each participant a certificate approved by the Department of Highways and Public Transportation which is evidence of qualification for the reduction in premium charges.

Each participant shall take an approved course every three years to continue to be eligible for the reduction in premium charges.

Nothing in this section prevents an insurer from offering appropriately reduced rates based solely on age to an insured person over the age of fifty-five years."

SECTION 2. This act takes effect upon approval by the Governor.
