A BILL

TO ABOLISH THE SOUTH CAROLINA DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AS A SEPARATE AND DISTINCT AGENCY OF STATE GOVERNMENT, THE STATE HIGHWAYS AND PUBLIC TRANSPORTATION COMMISSION, AND THE OFFICE OF EXECUTIVE DIRECTOR OF THE SOUTH CAROLINA DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION; TO ESTABLISH WITHIN THE OFFICE OF THE GOVERNOR THE DIVISION OF HIGHWAYS AND PUBLIC TRANSPORTATION AND PROVIDE FOR A DIRECTOR; TO DEVOLVE CERTAIN DUTIES, FUNCTIONS, AND RESPONSIBILITIES UPON THE DIVISION OF HIGHWAYS AND PUBLIC TRANSPORTATION; TO PLACE THE SUPERVISION, ADMINISTRATION, AND CONTROL OF THE SOUTH CAROLINA HIGHWAY PATROL IN THE HANDS OF THE STATE LAW ENFORCEMENT DIVISION; TO DEVOLVE CERTAIN DUTIES, FUNCTIONS, AND RESPONSIBILITIES UPON THE DIRECTOR OF THE DIVISION OF HIGHWAYS AND PUBLIC TRANSPORTATION; AND TO REPEAL SECTION 57-3-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE GOVERNMENT OF THE SOUTH CAROLINA DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION, SECTIONS 57-3-210, 57-3-215, 57-3-220, 57-3-230, 57-3-240, 57-3-250, 57-3-260, AND 57-3-270 ALL RELATING TO THE STATE HIGHWAYS AND PUBLIC TRANSPORTATION COMMISSION, AND SECTION 57-3-410 RELATING TO THE EXECUTIVE DIRECTOR OF THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The South Carolina Department of Highways and Public Transportation, as a separate and distinct agency or department of state government, the State Highways and Public Transportation Commission, and the office of executive director of the South Carolina Department of Highways and Public Transportation are abolished. In place of the South Carolina Department of Highways and Public Transportation there is established within the Office of the Governor the Division of Highways and Public Transportation. The Governor shall appoint a director of the division, with the advice and consent of the Senate, and the director shall administer the division. The Governor may remove the director at will.

SECTION 2. All of the duties, functions, and responsibilities conferred by Title 57 of the 1976 Code upon the South Carolina Department of Highways and Public Transportation are devolved upon the Division of Highways and Public Transportation, except for law enforcement duties, functions, and responsibilities, as embodied in the South Carolina Highway Patrol, which, as an entity, must be under the direct supervision, administration, and control of the State Law Enforcement Division. For the purposes of this section, all references in Title 57 to the South Carolina Department of Highways and Public Transportation must be construed to mean the Division of Highways and Public Transportation.

SECTION 3. All of the duties, functions, and responsibilities conferred by Title 57 of the 1976 Code upon the executive director of the South Carolina Department of Highways and Public Transportation, as well as all of the duties, functions, and responsibilities conferred by that title upon the State Highways and Public Transportation Commission, are devolved upon the director of the Division of Highways and Public Transportation. For the purposes of this section, all references in Title 57 to the executive director of the South Carolina Department of Highways and Public Transportation, as well as to the State Highways and Public Transportation Commission, must be construed to mean the director of the Division of Highways and Public Transportation.

SECTION 4. Sections 57-3-20, 57-3-210, 57-3-215, 57-3-220, 57-3-230, 57-3-240, 57-3-250, 57-3-260, 57-3-270, and 57-3-410 of the 1976 Code are repealed.

SECTION 5. This act takes effect July 1, 1992.
