A BILL

TO AMEND ACT 503 OF 1990, RELATING TO THE CLEAN INDOOR AIR ACT SO AS TO AUTHORIZE THE GOVERNING BODY OF ANY COUNTY OR MUNICIPALITY, BY ORDINANCE, TO PROHIBIT SMOKING IN SPECIFIED PUBLIC OR PRIVATE INDOOR AREAS OF ITS GOVERNMENTAL BUILDINGS WHERE SMOKING IS OTHERWISE PERMITTED UNDER THE CLEAN INDOOR AIR ACT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Act 503 of 1990 is amended by adding Section 4A:

"Section 4A. The governing body of any county or municipality, by ordinance, may prohibit smoking in specified public or private indoor areas of its governmental buildings where smoking is otherwise permitted under this act. In this event, the provisions of the local ordinance, rather than the provisions of this act, shall control. Any such local ordinances in effect on the effective date of this section are considered to have full force and effect."

SECTION 2. This act takes effect upon approval by the Governor.
