TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-1-115 SO AS TO AUTHORIZE THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION TO IMPOSE TOLLS ON STREETS, HIGHWAYS, OR BRIDGES UNDER ITS JURISDICTION UNDER CERTAIN CONDITIONS, TO PROVIDE FOR THE USE OF THE REVENUE DERIVED FROM THESE TOLLS, AND TO PROVIDE WHEN THE ABOVE PROVISIONS DO NOT APPLY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 57-1-115.The Department of Highways and Public Transportation, with the approval of the Highways and Public Transportation Commission, is authorized to impose tolls for the use of an existing street, highway, or bridge under the jurisdiction of the department or for the use of a future street, highway, or bridge to be under the jurisdiction of the department, which tolls are not in violation of applicable federal provisions of law, or applicable federal regulations or policies.
The department in imposing these tolls may grant discounts in the toll fees imposed for persons who travel that street, highway, or bridge on a daily or frequent basis.
The revenue derived from these tolls must be used by the department to pay for or reimburse the department or the state highway fund for the costs of construction of that street, highway, or bridge or to reduce or service the debt incurred to construct that street, highway, or bridge. Once the costs of construction have been paid for or reimbursed or the debt retired, no further tolls may be imposed on that street, highway, or bridge.
The department, by regulation and with the approval of the commission, shall prescribe the conditions and procedures necessary to implement the provisions of this section.
Where the provisions of Section 12-27-1290 authorizing tolls on roads built in conjunction with federal funds or the provisions of Section 57-5-1330 authorizing tolls for turnpike facilities are applicable to an existing or proposed street, highway, or bridge, the provisions of this section do not apply to that street, highway, or bridge."
SECTION 2. This act takes effect upon approval by the Governor.
