A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-15-450 SO AS TO PROHIBIT THE SALE, LEASE, DISTRIBUTION, OR RENTAL OF RECORDS, AUDIOTAPES, COMPACT DISCS, MUSIC VIDEOTAPES, AND OTHER RECORDINGS THAT CONTAIN SEXUALLY EXPLICIT LYRICS, LYRICS THAT ADVOCATE VIOLENCE OR CRIMINAL CONDUCT, OR LYRICS CONTAINING SWEAR OR CURSE WORDS TO PERSONS UNDER THE AGE OF EIGHTEEN YEARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-15-450. It is unlawful for a person to sell, rent, lease, or distribute to a person under the age of eighteen years any record, audiotape, music videotape, compact disc, or other recordings containing lyrics that:

(1) are obscene as defined in Section 16-15-305;

(2) are harmful to minors as defined in Section 16-15-375(1);

(3) advocate violence or other criminal conduct; or

(4) contain swear or curse words.

A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than one year or fined not more than five hundred dollars, or both."

SECTION 2. This act takes effect upon approval by the Governor.
