A BILL

TO AMEND SECTION 56-5-2715, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO STOP SIGNS AND REQUIRED STOPS AT DANGEROUS RAILROAD CROSSINGS, SO AS TO PROVIDE THAT THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION WITH RESPECT TO STATE HIGHWAYS AND COUNTIES AND MUNICIPALITIES WITH RESPECT TO HIGHWAYS WITHIN THEIR JURISDICTION SHALL PLACE WHITE LINES ACROSS THE LANES APPROACHING THESE DANGEROUS CROSSINGS AND TO PROVIDE THAT AT THOSE HIGHWAY AND RAILROAD GRADE CROSSINGS LOCATED WITHIN ONE-HALF MILE OF A CHURCH OR SCHOOL, THE RAILROAD COMPANY OPERATING THE RAILROAD SHALL PLACE AND MAINTAIN AN ILLUMINATED FLASHING RED SIGNAL ON THE HIGHWAY ON EACH SIDE OF THE CROSSING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-5-2715 of the 1976 Code is amended to read:

"Section 56-5-2715. The department, and local authorities with the approval of the department, may designate particularly dangerous highway grade crossings of railroads and erect stop signs thereat at the crossings. When such these signs are erected, the driver of any a vehicle shall stop within fifty feet, but not less than fifteen feet, from the nearest rail of the railroad and shall proceed only upon exercising due care. The department with respect to state highways and counties and municipalities with respect to streets and highways within their jurisdiction also shall place white lines across the lane or lanes approaching the crossing at the approximate location of the stop sign in the manner they consider appropriate.

In addition to the above requirements of this section, at those highway and railroad grade crossings located within one-half mile of a church or school, the railroad company operating the railroad shall place and maintain an illuminated flashing red signal on the street or highway on each side of the crossing in the manner the department or local authority having jurisdiction of the highway considers appropriate."

SECTION 2. This act takes effect upon approval by the Governor.
