TO APPROVE REGULATIONS OF THE COASTAL COUNCIL, RELATING TO AMENDMENTS TO THE COASTAL ZONE MANAGEMENT ACT, DESIGNATED AS REGULATION DOCUMENT NUMBER 1341, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Coastal Council, relating to amendments to the Coastal Zone Management Act, designated as Regulation Document Number 1341, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
These regulations will assist the affected public in complying with the 1990 amendments to the Coastal Zone Management Act, commonly called the Beachfront Management Act. The regulations describe and list the criteria and procedures for complying with the Beachfront Management Act. The procedures for establishing the baseline and setback line on the oceanfront property are enumerated. Criteria for new construction and reconstruction of habitable structures, pools, and other structures seaward of the setback line and baseline are listed. Criteria for determining the amount of damage to habitable structures, pools, erosion control devices, or structures are listed. Specific project standards for construction seaward of the setback line and baseline are catalogued. Administrative procedures for achieving compliance with the statute are enumerated.
