AN ACT TO AMEND SECTION 12-37-2740, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SUSPENSION OF DRIVER'S LICENSE AND REGISTRATION, SO AS TO PROVIDE THAT WRITTEN NOTIFICATION OF SUSPENSION BE IN A MANNER PROVIDED BY THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION; AND TO AMEND THE 1976 CODE BY ADDING SECTION 56-5-1275 SO AS TO PROVIDE CIRCUMSTANCES AND PROCEDURES FOR THE RELEASE OF MOTOR VEHICLE ACCIDENT REPORTS.
Be it enacted by the General Assembly of the State of South Carolina:
Suspension of driver's license and registration
SECTION 1. Section 12-37-2740 of the 1976 Code is amended to read:
"Section 12-37-2740. The department shall suspend the driver's license and motor vehicle registration of a person violating any provision of this article only upon written notification, in a manner determined by the department, from the county treasurer or municipal clerk treasurer stating that property taxes owed by the person have not been paid within the time limit prescribed by this article."
Requests for accident investigation reports
SECTION 2. The 1976 Code is amended by adding:
"Section 56-5-1275. With respect to a motor vehicle accident, no employee of any law enforcement agency shall allow any person to examine or obtain a copy of any accident report or related investigative report when the employee knows or should reasonably know that the request for access to the report is for commercial solicitation purposes. No person shall request any law enforcement agency to permit examination or to furnish a copy of any such report for commercial solicitation purposes. All persons, except law enforcement personnel and persons named in the report, shall be required to submit a separate written request to the law enforcement agency for each report. A written request under this section must state the requestor's name, address, and the intended use of the report in sufficient detail that the law enforcement agency may ascertain that the intended use is not for commercial solicitation purposes. A person who knowingly makes any false statement in any written request under this section shall be subject to the provisions of Section 56-3-2520."
SECTION 3. This act takes effect upon approval by the Governor.
