A CONCURRENT RESOLUTION

DIRECTING THE SOUTH CAROLINA DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO CONTRACT WITH AN INDEPENDENT FIRM TO CONDUCT AN INSPECTION AND EVALUATION OF THE PINEWOOD HAZARDOUS WASTE LANDFILL AND TO RECOMMEND REPAIRS AND OTHER APPROPRIATE ACTION UPON COMPLETION OF THE EVALUATION TO ASSURE THAT EXISTING LEAKS ARE SEALED, THAT NO NEW LEAKS WILL OCCUR, AND THAT ENVIRONMENTAL DAMAGE THAT HAS OCCURRED AS A RESULT OF THE COLLAPSED BERM AND RUPTURED LINER HAS BEEN CORRECTED.

Whereas, it was reported to the South Carolina Department of Health and Environmental Control that a sixty foot berm collapsed and a protective plastic liner ruptured at Laidlaw Environmental Services' Pinewood hazardous waste landfill; and

Whereas, since the report, five or more additional tears also have been discovered in the protective plastic liner; and

Whereas, thousands of tons of hazardous waste are stored at the Pinewood facility; and

Whereas, the escape of any hazardous materials from the facility could cause irreversible environmental damage to the surrounding area; and

Whereas, no determination has been made on the causes or effects of the tears in the protective plastic liner; and

Whereas, it is imperative to have the landfill facility thoroughly inspected to assure that no possibility of leakage and resulting environmental damage exists; and

Whereas, it is the duty of state government to protect and safeguard the health of the citizens and the environment of South Carolina. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the General Assembly of South Carolina directs the South Carolina Department of Health and Environmental Control to contract with an independent firm to conduct an inspection and evaluation of the Pinewood hazardous waste landfill and to recommend repairs and other appropriate action upon completion of the evaluation to assure that existing leaks are sealed, that no new leaks will occur, and that environmental damage that has occurred as a result of the collapsed berm and ruptured liner has been corrected.
