A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-25-30 SO AS TO AUTHORIZE CERTAIN ADVERTISING AND BUSINESS ON-PREMISE SIGNS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 57-25-30. (A) An advertising or a business on-premise sign is authorized under this chapter. The sign is one which directs attention to a business, commodity, attraction, profession, service, or entertainment conducted, sold, offered, manufactured, existing, or provided on the premises where the sign is located or to which it is affixed. The sign includes, but is not limited to:

(1) freestanding sign: secured permanently in the ground and not attached to, supported by, or erected on a building or other structure having a principal function other than support of the sign;

(2) moving message board: electrical or electronic sign using a pattern of lights to form various words or pictures capable of changing copy continuously;

(3) portable sign: rests upon but is not attached to the ground, a structure, a frame, a building, or another surface. The sign includes, but is not limited to, trailer, sandwich board, sidewalk or curb, and inflatable signs;

(4) windblown sign: a banner, pennant, flag spinner, streamer, or other sign designed to be moved by the wind.

(B) Signs authorized in this section include signs utilizing flashing or blinking lights or any type of pulsating or moving lights;

(C) This section does not authorize signs imitating official traffic signs or signals or symbols displayed in a manner to mislead or confuse drivers of motor vehicles or displaying intermittent lights resembling the color, size, shape, or order of lights customarily used in traffic signals, on emergency vehicles, or on law enforcement vehicles, except as part of permitted private or public traffic control signs.

(D) A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned not more than thirty days."

SECTION 2. This act takes effect upon approval by the Governor.
