A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-49-35 SO AS TO PROVIDE THAT THE LIEN SECURING THE PAYMENT OF PERSONAL PROPERTY TAXES ON BOATS NOT USED FOR BUSINESS PURPOSES IS NOT ENFORCEABLE AGAINST THE BOAT OWNED BY A SUBSEQUENT PURCHASER FOR FAIR MARKET VALUE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 49, Title 12 of the 1976 Code is amended by adding:

"Section 12-49-35. The lien established by this article to secure the payment of personal property taxes on a boat not used for business purposes is not enforceable against the boat owned by a subsequent purchaser who paid a fair market price for the boat."

SECTION 2. This act takes effect upon approval by the Governor.
