A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-17-41 SO AS TO PROVIDE FOR THE REGULATION OF SEASONS AND FISHING ACTIVITIES IN SALTWATERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-17-41. The department may establish open and closed seasons, areas, and fishing periods and prescribe limits and methods of taking fish in all saltwaters of the State, which includes all tidal waters from the saltwater-freshwater dividing lines established in Section 50-17-30, seaward to the state territorial limit.

All actions taken under the authority of this State must comply with the provisions of Section 50-17-90.

This section does not modify the provisions of existing laws dealing with the regulation of fishing seasons and activities in state waters.

A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be punished as provided in Section 50-17-100. Upon conviction for a second or subsequent violation of this section, the boat, motor, and fishing equipment of the violator must be confiscated and disposed of as provided in Section 50-17-650."

SECTION 2. This act takes effect upon approval by the Governor.
