TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 21 IN CHAPTER 1, TITLE 1, RELATING TO ADMINISTRATION OF THE GOVERNMENT, BY ENACTING THE GOVERNMENT AGENCY RECYCLING ACT SO AS TO REQUIRE GOVERNMENT AGENCIES AND INSTITUTIONS TO ADOPT RECYCLING PROGRAMS, TO AUTHORIZE THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION TO CONDUCT RECYCLING RESEARCH PROJECTS AND PERIODICALLY REVIEW ITS BID PROCEDURES TO ENCOURAGE RECYCLING, TO REQUIRE THE STATE DEPARTMENT OF EDUCATION TO DEVELOP RECYCLING GUIDELINES FOR PUBLIC SCHOOLS, AND TO PROVIDE THAT NET SAVINGS ACCRUING TO STATE AGENCIES AS A RESULT OF RECYCLING MUST BE CREDITED TO THE EDUCATION IMPROVEMENT ACT FUND.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 1 of the 1976 Code is amended by adding:
Section 1-1-1310. (A) Every state agency, board, committee, commission, and institution, including the General Assembly, shall establish by July 1, 1992, a program for the use of recycled materials and, to the extent feasible, for the collection of all recyclable materials used or generated by them, including, but not limited to, used motor oil, glass, aluminum, office paper, and corrugated paper.
(B) The program established pursuant to subsection (A) of this section must provide for procedures for:
(1) the collection and storage of recyclable materials generated;
(2) the disposal of these materials to buyers; and
(3) the reduction of waste materials generated.
Section 1-1-1320. The State Development Board shall encourage and promote the establishment of appropriate recycling industries in this State.
Section 1-1-1330. (A) The South Carolina Department of Highways and Public Transportation may conduct recycling research projects, including the establishment of demonstration projects which use recycled products in highway construction and maintenance. These projects may include by way of example and not by limitation the use of ground rubber from used tires or glass for road surfacing, resurfacing, and sub-base materials, and the use of plastic or mixed plastic materials for ground or guard rail posts, right-of-way fence posts, and sign supports.
(B) The department periodically shall review and revise its bid procedures and specifications to encourage the use of products and materials with recycled content in its construction and maintenance programs.
Section 1-1-1340. The State Department of Education shall develop guidelines for public schools regarding:
(1) the use of recycled materials;
(2) the collection of recycled materials; and
(3) the reduction of solid waste generated in public school offices, classrooms, and cafeterias.
Section 1-1-1350. Any cost savings generated by a state agency recycling program must be credited to the Education Improvement Act Fund."
SECTION 2. This act takes effect upon approval by the Governor.
