TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO CERTIFICATION OF NEED FOR HEALTH FACILITIES AND SERVICES, DESIGNATED AS REGULATION DOCUMENT NUMBER 1335, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Health and Environmental Control, relating to Certification of Need for Health Facilities and Services, designated as Regulation Document Number 1335, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
Regulation 61-15, Certification of Need for Health Facilities and Services requires amendment in order to be consistent with the statute which was amended by S927. The proposed regulation amends the existing regulation so as to provide for the payment of an initial application fee; to change the time during which an applicant is required to publish notice of his application; to reduce the time the applicant has to provide additional information to complete the application; to reduce the time of the review period for the application; to reduce the time by which the staff decision becomes the final agency decision; to provide for appeal to the circuit court instead of the appropriate state court; to provide for the requirements of the appeal; to change the time period during which a Certificate of Need is valid; to revise the circumstances under which an extension may be granted; to require a timetable for completion of a project; to raise the threshold for an expenditure made for the preparation of a project; to redefine competing applicants; to define initial application fee, filing fee and issuance fee; to amend examples of endorsement for the community; and to clarify how the criteria will be applied.
