A BILL

TO AMEND SECTION 38-74-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE HEALTH INSURANCE POOL, SO AS TO PROVIDE ADDITIONAL POWERS FOR THE BOARD OF DIRECTORS OF THE POOL TO CONTAIN INSURANCE COSTS, REQUIRE THE CHIEF INSURANCE COMMISSIONER'S APPROVAL BEFORE THE POOL MAY ISSUE INSURANCE POLICIES, AND DELETE DETAILED PROVISIONS REGARDING PAYMENT OF BENEFITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 38-74-20 of the 1976 Code, as last amended by Act 75 of 1991, is further amended by adding an appropriately lettered subsection to read:

"( ) In addition to its general powers, the board may take measures to contain insurance costs subject to the commissioner's approval including, but not limited to:

(1) provide for and employ cost containment measures and requirements including, but not limited to, preadmission screening, second surgical opinion, concurrent utilization review, and individual case management for the purpose of making the benefit plan more cost effective;

(2) design, utilize, contract, or otherwise arrange for delivery of cost effective health care services including establishing or contracting with preferred provider organizations, health maintenance organizations, or other limited network provider arrangements."

SECTION 2. Section 38-74-20(F)(6) of the 1976 Code, as last amended by Act 568 of 1990, is further amended to read:

"(6) subject to the commissioner's approval, issue policies of insurance in accordance with the requirements of this act, payment of benefits at the rate of eighty percent of covered medical expenses which are in excess of a five hundred dollar deductible, until twenty percent of the expenses in a benefit period reaches one thousand five hundred dollars, after which benefits must be paid at the rate of one hundred percent during the remainder of the benefit period chapter;"

SECTION 3. This act takes effect upon approval by the Governor.
