A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 58-1-60 SO AS TO PROVIDE THAT WHENEVER AN EMPLOYEE OF A UTILITY USES HIS EMPLOYER-SUPPLIED IDENTIFICATION TO GAIN ADMISSION TO THE BUSINESS OR RESIDENCE PREMISES OF A CUSTOMER OF THE UTILITY TO REPAIR OR MAINTAIN EQUIPMENT OR SERVICE, THE EMPLOYER SHALL BE LIABLE FOR THE ACTS OF ITS EMPLOYEE WHICH CAUSE DAMAGE OR INJURY WHILE ON OR WITHIN THE CUSTOMER'S PREMISES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 1, Title 58 of the 1976 Code is amended by adding:

"Section 58-1-60. Whenever an employee of any utility, as defined in this section, uses his employer-supplied identification to gain admission to the business or residence premises of a customer of the utility for the purpose, expressed or implied, of repairing or maintaining equipment or service, the employer shall be liable for those acts of its employee which cause damage or injury while on or within the customer's business or residence premises.

For the purposes of this section, `utility' means `public utility' as defined in Section 58-5-10(3) and any telephone company, telegraph company, express company, radio common carrier, carrier, railroad company, steamboat company, canal company, pipeline company, electric, interurban, and street railway company, motor vehicle carrier, electric utility, electric cooperative, and cable television company as may be defined in and regulated by this title."

SECTION 2. This act takes effect upon approval by the Governor.
