A JOINT RESOLUTION

TO DIRECT ALL LAW ENFORCEMENT AGENCIES TO USE A TINT CHECK CARD IN THE ENFORCEMENT OF SECTION 56-5-5015, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SUNSCREEN DEVICES USED IN CONJUNCTION WITH THE SAFETY GLAZING MATERIALS OF MOTOR VEHICLE WINDOWS ON MOTOR VEHICLES MANUFACTURED ON OR BEFORE JANUARY 1, 1989.

Whereas, the vehicle window tinting requirements which became effective on all motor vehicles January 1, 1992, have created a great deal of confusion concerning the proper enforcement of the law; and

Whereas, both tint meters and tint check cards are being used to measure the light transmission through tinted windows and often produce conflicting results; and

Whereas, these conflicting results clearly demonstrate an unequal application of the law which must be corrected; and

Whereas, in order to clarify the confusion and ambiguity surrounding the enforcement of the motor vehicle window tinting law, it is necessary to suspend enforcement of the law for those vehicles not heretofore required to comply. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. All law enforcement agencies shall use a tint check card in the enforcement of Section 56-5-5015 of the 1976 Code relating to sunscreen devices used in conjunction with the safety glazing materials of motor vehicle windows on motor vehicles manufactured on or before January 1, 1989.

SECTION 2. This joint resolution takes effect upon approval by the Governor.
