A BILL

TO AMEND SECTION 2-7-60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ANNUAL GENERAL APPROPRIATION ACT, SO AS TO PROVIDE FOR AN EXCEPTION TO THE PROVISIONS OF THAT SECTION AND TO MAKE REFERENCE TO NEW SECTION 2-7-61; TO AMEND THE 1976 CODE BY ADDING SECTION 2-7-61 SO AS TO REQUIRE THE GENERAL ASSEMBLY TO ANNUALLY PROVIDE FOR ALL EXPENDITURES FOR THE STATE EDUCATION DEPARTMENT IN A SEPARATE APPROPRIATION ACT, PROVIDE FOR THE APPROPRIATIONS THEREBY MADE FOR THE STATE EDUCATION DEPARTMENT, REQUIRE THE ANNUAL APPROPRIATION BILL FOR THIS AGENCY TO BE CONSIDERED PRIOR TO THE GENERAL APPROPRIATION BILL FOR THE REMAINDER OF STATE GOVERNMENT, AND PROVIDE THAT ALL OTHER PROVISIONS OF LAW RELATING TO THE ANNUAL GENERAL APPROPRIATION ACT WHICH ARE NOT IN CONFLICT WITH THE PROVISIONS OF SECTION 2-7-61 APPLY TO THE ANNUAL APPROPRIATION ACT FOR THE STATE EDUCATION DEPARTMENT; AND TO AMEND SECTION 2-7-66, RELATING TO EDUCATION IMPROVEMENT ACT APPROPRIATIONS TO AGENCIES AND ENTITIES OTHER THAN THE STATE EDUCATION DEPARTMENT, SO AS TO PROVIDE THAT THESE APPROPRIATIONS BE INCLUDED IN THE ANNUAL APPROPRIATION BILL FOR THE STATE DEPARTMENT OF EDUCATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 2-7-60 of the 1976 Code is amended to read:

"Section 2-7-60. Except as otherwise provided in Section 2-7-61, The the General Assembly shall annually provide for all expenditures in the general appropriation act and the appropriations made for any department, institution, board, or commission shall be in a definite sum for each purpose or activity with such itemization under the activity as may be deemed necessary by the General Assembly."

SECTION 2. The 1976 Code ia amended by adding:

"Section 2-7-61. Notwithstanding any other provision of law, the General Assembly shall annually provide for all expenditures for the State Education Department in a separate appropriation act for that department of state government only, and the appropriations made for the State Education Department shall be in a definite sum for each purpose or activity with such itemization under the activity as may be deemed necessary by the General Assembly. The annual appropriation bill for the State Education Department shall be considered in each house of the General Assembly prior to the general appropriation bill for the remainder of state government.

All other provisions of law relating to the annual general appropriation act which are not in conflict with the provisions of this section apply to the annual appropriation act for the State Education Department mutatis mutandis."

SECTION 3. Section 2-7-66 of the 1976 Code, as added by Part II, Section 29 of Act 658 of 1988, is amended to read:

"Section 2-7-66. Education Improvement Act of 1984 appropriations for programs which are administered by agencies and entities other than the State Department of Education must be included in the annual general appropriations bill under the section containing appropriations for the State Department of Education, pursuant to Section 2-7-61, in a separate subsection titled `Education Improvement Act Appropriations to Other Agencies and Entities';. Funds appropriated under this subsection must be disbursed to the agencies and entities by the State Treasurer in accordance with state accounting policies and procedures."

SECTION 4. Upon approval by the Governor, this act is effective for the State's budgeting process for appropriations and expenditures for the 1992-93 fiscal year and for each fiscal year thereafter.
