A BILL

TO AMEND SECTION 16-25-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PENALTIES FOR A THIRD CONVICTION OF DOMESTIC VIOLENCE, SO AS TO PROVIDE THAT PRIOR CONVICTIONS FOR VIOLENT ACTS AGAINST A PERSON WHO IS A FAMILY OR HOUSEHOLD MEMBER ARE INCLUDED FOR SENTENCING PURPOSES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-25-40 of the 1976 Code is amended to read:

"Section 16-25-40. Any person who violates Section 16-25-20 after having previously been twice convicted of a violation of Section 16-25-20 or of violent acts against a person whose relationship with the defendant is defined by this article must be punished, upon conviction, by a fine of not more than three thousand dollars or by imprisonment for not more than three years, or both."

SECTION 2. This act takes effect upon approval by the Governor.
