TO AMEND SECTION 8-21-1010, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FEES TO BE COLLECTED BY MAGISTRATES, SO AS TO CLARIFY FEES IN CIVIL ACTIONS, INCLUDING FEES IN ACTIONS BROUGHT BY LANDLORDS OR LESSORS, AND TO ADD THE COLLECTION OF FEES FOR INITIATING A PROCEEDING TO FORECLOSE A LIEN.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 8-21-1010(6) of the 1976 Code, as last amended by Act 678 of 1988, is further amended to read:
"(6) in all civil actions not otherwise provided for in this section, for issuing a summons and a copy for each defendant, and for giving judgment with or without a hearing, twenty-five dollars; this fee is in addition to the fee for service of process in Section 8-21-1060(4) for each defendant;".
SECTION 2. Section 8-21-1010(9) of the 1976 Code, as last amended by Act 678 of 1988, is further amended to read:
"(9) for each proceedings proceeding by a landlord or lessor against a tenant or, lessee, or trespasser, including notices to quit, applications for ejectment, writs of ejectment, or other eviction orders, or recovery of rents, ten dollars for each paper; this fee is in addition to the fee for service of process in Section 8-21-1060(4) for each defendant;".
SECTION 3. Section 8-21-1010 of the 1976 Code, as last amended by Act 678 of 1988, is further amended by adding:
"(15) for initiating a proceeding to foreclose a lien, to sell personal property under statutory authority, or any other proceeding in which a magistrate or constable must conduct a sale, twenty-five dollars; this fee is in addition to any applicable fees in Section 8-21-1060."
SECTION 4. This act takes effect upon approval by the Governor.
