A BILL

TO AMEND SECTION 16-15-140, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFENSE OF COMMITTING OR ATTEMPTING A LEWD ACT UPON A CHILD, SO AS TO CHANGE THE AGE OF THE PERSONS TO WHICH THE OFFENSE APPLIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-15-140 of the 1976 Code is amended to read:

"Section 16-15-140. It shall be is unlawful for any a person over the age of fourteen sixteen years of age or older to wilfully and lewdly commit or attempt any a lewd or lascivious act upon or with the body, or any a part or member thereof of the body, of a child under the age of fourteen sixteen years, with the intent of arousing, appealing to, or gratifying the lust or passions or sexual desires of such the person or of such the child. Anyone A person violating the provisions of this section shall, upon conviction, must be punished by fine fined or imprisonment imprisoned, or both, in the discretion of the court."

SECTION 2. This act takes effect upon approval by the Governor.
