A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-15-145 SO AS TO PROVIDE FOR THE OFFENSE OF CONTINUOUS SEXUAL ABUSE OF A CHILD AND TO AMEND SECTION 16-1-10, AS AMENDED, RELATING TO THE CRIMES CLASSIFIED AS FELONIES, SO AS TO INCLUDE THE OFFENSE PROVIDED IN THIS ACT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-15-145. A person who resides in the same home with a child under sixteen years of age or has recurring access to the child and who within not less than three months engages in three or more acts of substantial sexual conduct with the child or three or more acts of lewd or lascivious conduct with the child is guilty of the felony offense of continuous sexual abuse of a child and, upon conviction, must be imprisoned for thirty years. As used in this section sexual conduct is defined as in Article 7, Chapter 3 of Title 16, and lewd or lascivious conduct is defined as in Section 16-15-140."

SECTION 2. The offense of continuous sexual abuse of a child provided in Section 16-15-145 of the 1976 Code, as added by Section 1, is added to the list of crimes classified as felonies in Section 16-1-10.

SECTION 3. This act takes effect upon approval by the Governor.
