AN ACT TO AMEND ACT 256 OF 1981, AS AMENDED, RELATING TO THE SCHOOL DISTRICT OF MARLBORO COUNTY, SO AS TO CHANGE THE MARLBORO COUNTY BOARD OF EDUCATION FROM SEVEN TO NINE MEMBERS, TO PROVIDE THAT ALL MEMBERS MUST BE ELECTED IN 1992 EXCEPT THOSE WHOSE TERMS DO NOT EXPIRE IN 1992, TO CHANGE THE SINGLE-MEMBER DISTRICTS FROM SIX DISTRICTS TO EIGHT DISTRICTS WHICH CORRESPOND TO THE ELECTION DISTRICTS FOR THE ELECTION OF MEMBERS TO THE COUNTY COUNCIL OF MARLBORO COUNTY, AND TO PROVIDE PER DIEM OF THIRTY-FIVE DOLLARS A MEETING.

Be it enacted by the General Assembly of the State of South Carolina:

Marlboro County School Board members

SECTION 1. Section 3 of Act 256 of 1981 is amended to read:

"Section 3. The governing body of the School District of Marlboro County is a board known as the Marlboro County Board of Education. The board consists of nine members who, beginning with the 1992 election, must be elected in the manner specified in this act. The members of the Marlboro County Board of Education serving in office on the effective date of this act shall continue to serve until their terms expire, at which time the members of the board elected in the manner specified by this act shall take office. All members of the board must be elected in the 1992 election except those members of the board currently serving whose terms do not expire in 1992 shall continue to serve and shall represent the districts in which they reside until their terms expire."

Board members, elections, terms, vacancies

SECTION 2. Section 4 of Act 256 of 1981 is amended to read:

"Section 4. The members of the Marlboro County Board of Education must be elected in a nonpartisan election to be held at the same time as the general election for terms of office of four years each. Successors to members must be elected in a nonpartisan election to be held at the same time as the general election. Members of the board shall serve until their successors are elected and qualify. Members shall take office on the first day of January following their election. In any election, the candidate receiving the highest number of votes is elected to the board.

A vacancy occurring for a reason other than expiration of a term must be filled by election of the board by majority vote until the next scheduled election at which time a successor must be elected for the remainder of the unexpired term or for a full term as the case may be."

Single-member election districts

SECTION 3. Section 5 of Act 256 of 1981 is amended to read:

"Section 5. For the purpose of electing members of the Marlboro County Board of Education beginning in 1992, the School District of Marlboro County is divided into eight single-member election districts

corresponding with the eight single-member election districts for the election of members to the county council of Marlboro County."

Residency requirements

SECTION 4. Section 6 of Act 256 of 1981, as last amended by Act 556 of 1982, is further amended to read:

"Section 6. One member of the Marlboro County Board of Education must be elected from each of the eight single-member election districts as provided for in Section 5 of this act and in addition the chairman is the ninth member of the board and must be elected from the school district at large by the qualified electors of the school district. The office of chairman is a separate office and a person desiring to run for chairman specifically shall file and run for the office. The member of the board elected from each single-member election district must be a resident of that district and must be elected by the qualified electors of that district. A person desiring to qualify as a candidate and be elected to the board from a specific district or as chairman shall file written notice of candidacy with the county election commission at least thirty days before the date set for the election but not earlier than sixty days before the election. This notice of candidacy must be a sworn statement and must include the candidate's name, age, voting precinct, single-member election district in which the candidate resides, period of residence in the election district and other information the county election commission requires.

The county commissioners of election shall conduct and supervise all elections for members of the board in the manner governed by the election laws of this State, mutatis mutandis. The commissioners shall prepare the necessary ballots, appoint managers for the voting precincts, and do all things necessary to carry out the elections, including counting ballots and declaring the results. The commissioners shall advertise the date of an election sixty days before the election in a newspaper of general circulation published in Marlboro County and shall publish a second notice two weeks after the first notice. The cost of the election must be borne by Marlboro County.

The results of the election must be determined in accordance with the nonpartisan plurality method prescribed by Section 5-15-61 of the 1976 Code."

Board meetings and officers

SECTION 5. Section 7 of Act 256 of 1981, as last amended by Act 556 of 1982, is further amended to read:

"Section 7. The board shall hold regular monthly meetings upon the call of the chairman and shall hold special meetings at other times as may be necessary, also upon call of the chairman, or upon the call of three members. The board shall elect a vice-chairman, a secretary, and other officers as it considers necessary, who shall hold office for a term of one year and until their successors are elected by the board. The board may designate the county superintendent of education as assistant secretary of the board. Members of the board shall receive a per diem allowance of thirty-five dollars for each meeting of the board. In addition, the chairman shall receive additional compensation of one hundred fifty dollars a month."

Time effective

SECTION 6. This act takes effect upon approval by the Governor.
