TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-20-68 SO AS TO PROVIDE THAT ANY SCHOOL DISTRICT OF THIS STATE WHICH DOES NOT HAVE A ONE HUNDRED THIRTY-FIVE DAY AVERAGE DAILY MEMBERSHIP (ADM) OF ONE THOUSAND TWO HUNDRED STUDENTS BEGINNING WITH THE 1993-94 SCHOOL YEAR SHALL HAVE STATE FUNDS APPROPRIATED FOR SCHOOL DISTRICT EMPLOYER CONTRIBUTIONS ALLOCATED TO IT BASED ON THE FORMULA IN EFFECT ON JANUARY 1, 1992, AND TO PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-20-68. The General Assembly finds that for a school district to operate efficiently and economically, certain economies of scale are necessary in regard to administration, support services, transportation, and other related nonteaching considerations. It has therefore determined in this section to provide that, notwithstanding any other provision of law, any school district of this State which does not have a one hundred thirty-five day average daily membership (ADM) of one thousand two hundred students beginning with the 1993-94 school year shall have state funds appropriated for school district employer contributions allocated to it based on the formula in effect on January 1, 1992. The provisions of this section, however, do not apply to any school district the area of which consists of at least an entire county and which does not have a one hundred thirty-five day average daily membership (ADM) of one thousand two hundred students."
SECTION 2. This act takes effect upon approval by the Governor.
