A BILL

TO AMEND SECTION 50-17-440, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE USE OF AND RESTRICTIONS ON NETS IN SALTWATER, SO AS TO CHANGE THE REQUIREMENTS FOR THE LENGTH OF A GILL NET.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-17-440 of the 1976 Code is amended to read:

"Section 50-17-440. The use of trammel, pound, fyke, stop nets, and purse seines in the waters of this State from the saltwater-freshwater dividing line seaward is prohibited. The use of gill nets, except gill nets one two hundred feet in length or less with a minimum mesh size of three inches stretched used in the Atlantic Ocean from the beaches seaward and only in those areas of the bays and sounds designated by the Division of Marine Resources for such those purposes, is prohibited, except as permitted by Article 8 of this chapter. The user of a gill net must be within one hundred yards or hailing distance of the net at all times when it is in use."

SECTION 2. This act takes effect upon approval by the Governor.
