TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 58-5-390 SO AS TO PROHIBIT THE PUBLIC SERVICE COMMISSION FROM APPROVING WEATHER NORMALIZATION ADJUSTMENTS WHICH ARE INTENDED TO ELIMINATE FLUCTUATIONS IN THE EARNINGS OF A PUBLIC UTILITY WHICH SUPPLIES GAS TO ITS CUSTOMERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 58-5-390. The commission may not approve a weather normalization adjustment for a public utility which provides gas to its customers, the purpose of the adjustment being to eliminate the fluctuations in the earnings of the utility."
SECTION 2. This act takes effect upon approval by the Governor.
