A BILL

TO AMEND SECTION 4-9-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO POWERS OF COUNTY GOVERNMENT, SO AS TO AUTHORIZE THE IMPOSITION OF A TIPPING FEE ON THE DISPOSAL OF OUT-OF-STATE WASTE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 4-9-30 of the 1976 Code is amended by adding:

"(18) to impose a fee for each ton of solid waste generated out of state and disposed of in the county, except that if the state in which the waste was generated has a higher tipping fee for disposal of in-state or out-of-state solid waste than that imposed by the county, then the higher fee must be imposed."

SECTION 2. This act takes effect upon approval by the Governor.
