TO AMEND SECTIONS 16-23-210 AND 23-31-310, BOTH AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS FOR PURPOSES OF FIREARMS AND FIREARM OFFENSES, SO AS TO REVISE THE DEFINITION OF "MILITARY FIREARM" SO THAT THE DEFINITION INCLUDES ONLY ENUMERATED DESTRUCTIVE DEVICES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 16-23-210(g) of the 1976 Code, as added by Act 564 of 1990, is amended to read:
"(g) `Military firearm' means any military weapon, firearm, or destructive device, other than a machine gun, that is manufactured for military use by a firm licensed by the federal government pursuant to a contract with the federal government an explosive, incendiary, or poison gas:
(1) bomb;
(2) grenade;
(3) rocket having a propellant charge of more than four ounces;
(4) missile having an explosive or incendiary charge of more than one-quarter ounce;
(5) mine; or
(6) device similar to the devices described in subitems (1) through (5) of this item."
SECTION 2. Section 23-31-310(g) of the 1976 Code, as added by Act 564 of 1990, is amended to read:
"(g) `Military firearm' means any military weapon, firearm, or destructive device, other than a machine gun, that is manufactured for military use by a firm licensed by the federal government pursuant to a contract with the federal government an explosive, incendiary, or poison gas;
(1) bomb;
(2) grenade;
(3) rocket having a propellant of more than four ounces;
(4) missile having an explosive or incendiary charge of more than one-quarter ounce;
(5) mine; or
(6) device similar to the devices described in subitems (1) through (5) of this item."
SECTION 3. This act takes effect upon approval by the Governor.
