A BILL

TO PROVIDE THAT THE ELECTION OF ALL MEMBERS OF BOARDS OF TRUSTEES OF SCHOOL DISTRICTS IN LEXINGTON COUNTY MUST BE HELD IN NONPARTISAN ELECTIONS AT THE TIME OF THE GENERAL ELECTION, PROVIDE FOR THE METHOD OF NOMINATION OF CANDIDATES AND CONDUCT OF THE ELECTION, AND TO EXTEND THE TERMS OF THOSE PERSONS AFFECTED BY THESE PROVISIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Beginning with the general election of 1992, all members of boards of trustees of school districts in Lexington County must be elected in nonpartisan elections at the time of the general election.

SECTION 2. If the election day, as provided for in Section 1 of this act, occurs before or after the end of the term of any person affected by this act, the term is extended until his successor is elected at the next general election. The terms of all persons elected pursuant to this act begin on the first day of January following the election.

SECTION 3. (A) Candidates for office which are filled in nonpartisan elections on the effective date of this act must be nominated by the method provided by law for the office affected.

(B) Candidates for office which are filled in partisan elections on the effective date of this act must be nominated as provided in Section 7-11-70 of the 1976 Code.

SECTION 4. The election provided for in this act must be conducted pursuant to the provisions of Title 7 of the 1976 Code, except as otherwise provided for in this act.

SECTION 5. This act takes effect upon approval by the Governor.
