A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 5-31-460 SO AS TO PROVIDE THAT THE STATE OR ANY POLITICAL SUBDIVISION SHALL ALLOW FORMER RIPARIAN LAND OWNERS ACCESS TO THE INLAND WATERWAYS WHICH ARE ASSOCIATED WITH THEIR FORMER OWNERSHIP.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 31 of Title 5 of the 1976 Code is amended by adding:

"Section 5-31-460. The State or any political subdivision which has obtained land through condemnation or outright purchase shall allow the former riparian landowner, and his heirs and assigns, unrestricted access to any inland waterway which is associated with the former riparian ownership. Nothing in this section, however, is to be construed as prohibiting the State or political subdivision from denying such access for public safety reasons."

SECTION 2. This act takes effect upon approval by the Governor.
