A BILL

TO AMEND SECTION 50-11-1910, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE UNLAWFUL SALE OF DEER AND DEER PARTS, SO AS TO PROVIDE THAT IT IS UNLAWFUL TO SELL, TRADE, OR BARTER BIRDS PROTECTED BY STATE LAW, GAME FISH, AND ANIMALS, EXCEPT FURBEARERS, AND TO REVISE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-11-1910 of the 1976 Code is amended to read:

"Section 50-11-1910. It is unlawful to buy, or sell, offer for sale, trade, or barter, or offer to buy, sell, trade, or barter, or have in possession for sale, trade, or barter any bird, except those unprotected by state law, any game fish, or game animal, or any part of a game fish or animal, except the hides or body parts of furbearers as defined in Section 50-11-2400, and any deer or part of a deer except the hide of legally taken deer. Hides from legally taken deer may be bought, sold, or bartered during the earliest open season for the taking of deer and for thirty calendar days following the end of the latest deer season. A person who violates this section, upon conviction, must be punished in accordance with the penalties in Section 50-1-125. For a violation of this section, upon conviction, the guilty party for a first offense must be fined not less than one hundred dollars nor more than three hundred dollars or be imprisoned for not more than thirty days; for a second offense within three years of the date of conviction for a first offense, the person must be fined not less than three hundred dollars nor more than five hundred dollars or be imprisoned for not more than thirty days, for a third offense within three years of the date of conviction for a first offense, the person must be fined one thousand dollars or be imprisoned for not more than sixty days."

SECTION 2. This act takes effect upon approval by the Governor.
