A BILL

TO AMEND SECTION 50-13-1640, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DRAWING OF A PRIVATE POND BY THE OWNER, SO AS TO PROVIDE THAT THE POND MUST BE DRAWN IN THE PRESENCE OF OR UNDER THE SUPERVISION OF A REPRESENTATIVE OF THE DEPARTMENT OF WILDLIFE AND MARINE RESOURCES AND THAT FISH TAKEN AT THE DRAWING MAY BE SOLD ONLY TO THE ULTIMATE CONSUMER AND MAY NOT BE RESOLD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-13-1640 of the 1976 Code is amended to read:

"Section 50-13-1640. It shall be lawful for the The owner of any a private pond, in the presence of and or under the supervision of a representative of the Division of Game, to department, may draw such the pond and dispose of the fish caught at such the drawing, by sale or otherwise. But any All fish sold must be sold to the ultimate consumer and disposed of at the pond site of the pond in the presence of a representative of the Division of Game. The fish may not be resold."

SECTION 2. This act takes effect upon approval by the Governor.
